Victory in first stage of 'fitness for work' court case ? welsh disability ...

Two disabled people have won the first stage of their legal bid to force the government to improve the much-criticised ?fitness for work? test.

The high court this week granted permission for them to bring a claim for judicial review against Iain Duncan Smith, the Conservative work and pensions secretary.

The two disabled people, both supported by the Mental Health Resistance Network (MHRN), claim that the work capability assessment (WCA) discriminates against people with mental health conditions.

The WCA was introduced by the Labour government in 2008 but is now a centrepiece of the coalition?s welfare reforms, and is used to determine eligibility for employment and support allowance (ESA), the replacement for incapacity benefit (IB).

Lawyers for MM and DM ? who have been granted anonymity by the court ? say many ESA claims are decided through assessments by healthcare professionals who are not mental health specialists.

They argue that the WCA fails to make reasonable adjustments under the Equality Act for people with mental health conditions, and are calling on the Department for Work and Pensions (DWP) and Atos Healthcare ? the private company which carries out the tests ? to seek medical evidence at the beginning of each claim.

Mr Justice Edwards-Stuart, granting permission for a judicial review, said that it was ?reasonably arguable? that ?early obtaining? of independent medical evidence was a reasonable adjustment under the Equality Act for claimant with mental health conditions and ?that this has not been done, or at least not done on a sufficiently widespread basis?.

A judicial review victory will not lead to the WCA being scrapped, but could make it fairer and less stressful for those with mental health problems, while some could be exempted from having to undergo a face-to-face assessment.

Ravi Low-Beer, MM and DM?s solicitor, from the Public Law Project, said: ?The present system results in many thousands of unnecessary appeals at great public expense, with a high success rate.

?What is not counted is the cost in human misery for those people who should never have had to go through the appeals process in the first place.

?This could be avoided if doctors were involved in the assessments at the outset. The government?s policy of bypassing doctors is inefficient, unfair and inhumane.

?We gain heart from the court?s findings that as a matter of law, it is arguable that something has to change.?

He said he hoped the judicial review hearing would take place later this year.

Dave Skull, an MHRN member, also welcomed the court?s decision, and said: ?A number of people have been wrongly assessed and misrepresented by the current situation. It is vital that there is some sort of review.?

He said many people with mental health conditions were in a ?vulnerable position? and were experiencing ?incredible anxiety? because of the WCA?s flaws, and added: ?I am supporting a lot of people who are feeling suicidal about the situation with their WCA.?

The MHRN was formed in 2010 by people claiming IB on mental health grounds, who were concerned about the proposed programme to reassess all those on the benefit for their eligibility for ESA.

Many of the network?s members have had relapses, episodes of self-harm and suicide attempts, and have needed higher levels of medication and even hospitalisation in the lead-up to their reassessment.

Thousands of people with mental distress have been found unfairly fit for work following their WCA, and while many go on to win an appeal against this decision, some are unable to cope with an appeal, or experience a relapse in their health as a result of the process.

A DWP spokeswoman said: ?Government welfare reforms have a long history of being taken to judicial review so this is little surprise and we will be challenging this claim vigorously.

Understand the role of White Balance in Digital Cameras











White balance is central to photography. It is the way in which the camera captures colors as they are. In theory when you white balance a picture, you essentially ensure that the white in real looks as white in the picture too. What this does is that it enables the digital cameras sensors to interpret other colors correctly. However this is easier said than done. There are various shades of white, some cooler (which render a bluer tint) and others warmer (which render a yellowish tint) that can confuse the camera and you may end up capturing altered colors.

To counter this, modern digital cameras come loaded with White Balance presets most noteworthy of which is the Auto White Balance mode. It is also by far the most commonly used White Balance preset by default. Auto White Balance in digital cameras tries to average out the color temperatures and thus capture an average color picture. This may or may not be to your liking.

So what does one do?

The answer lies in the plethora of other white balance presets such as Cloudy, Shade, Florescent et al. These presets work in an interesting way. While they stand for a certain condition like Shade or Cloudy, they work differently. They try to average out such conditions e.g a Cloudy preset tries to compensate for the bluish tones present in shade and bring in more of warm tone in the picture. A cloudy does the same. Florescent, on the other hand, does the opposite.

The most powerful preset of all is the Custom White Balance preset. It is the most difficult to master as well. To use this preset, you need to select a white or a grey spot in the picture that define the perfect grey and use that as a reference for rest of the colors. Once chosen, the same custom white balance can be used across different images, given that the lighting conditions are the same.

In short, one should remember that role of white balance is to capture colors as the eye sees it. By dialing through the various modes and presets, you can learn what preset suits the conditions and leverage that to capture crisp pictures.

Graphene re-knits its holes

ScienceDaily (July 29, 2012) ? Scientists at The University of Manchester and the SuperSTEM facility at STFC's Daresbury Laboratory have discovered that the 'miracle material', graphene, undergoes a self repairing process to mend holes.

This research, published in Nano Letters, could hold the key in the quest to realise graphene's huge potential for use in fields from electronics to medicine.

Graphene, which is made of sheets of carbon just one atom thick, is a promising material for a wide range of future applications due, for instance, to its exceptional electronic properties.

The team, led by Professor Kostya Novoselov, who shared a Nobel Prize in Physics in 2010 for exploiting the remarkable properties of graphene's, was originally looking to gain a deeper understanding into how metals interact with graphene, essential if it is to be integrated into practical electronic devices in the future.

The researchers were using a powerful electron microscope at the SuperSTEM Laboratory at Daresbury, which allows scientists to study the properties of materials one atom at a time. They recently demonstrated that metals can initiate the formation of holes in the graphene sheet, which could be hugely detrimental to the properties of any graphene-based device.

Surprise results then showed that some of the holes that had been created during this process were actually mending themselves spontaneously using nearby loose carbon atoms to re-knit the graphene structure.

Dr Quentin Ramasse, Scientific Director at SuperSTEM said: "This was a very exciting and unexpected result. The fact that graphene can heal itself under the right conditions may be the difference between a working device and a proof of concept without any real application. We may now have a way of not only drilling through graphene in a controlled fashion to sculpt it at the atomic level, but also to grow it back in new shapes. This adds a lot of flexibility to our nanotechnology toolbox and could pave the way to future technological applications."

SuperSTEM (link opens in a new window) is the EPSRC National Facility for Aberration Corrected STEM and is run by a consortium of universities, consisting of Leeds, Glasgow, Liverpool, Manchester and Oxford. Other collaboration agreements with the external partner universities Cambridge, Sheffield, Warwick and York will be commencing shortly and the facility has received ?4.5M funding from EPSRC.

Unlike stocks, gold and silver have a spot price. The spot price in any given time is the difference between the BID (Selling back to market) price and the ASK (Buying from the market price). So if the Bid price is $ 1300.00 and the Ask price is $ 1302.00 then the spot price is $ 1301.00. The spot price ONLY refers to PAPER gold not PHYSICAL gold and silver. Now in addition to the spot price the PHYSICAL metals market has a premium on the physical metal. These premiums vary as to exactly the type of product being bought. Coins always carry a higher premium then bars. Then you have premium differences for bullion coins and numismatic coins. It is vital to learn and know the differences betewwn these types of coins.

As Alan Greenspan former Chairman of the Federal Reserve said ?.

?In the absence of the gold standard, there is no way to protect savings from confiscation through inflation. There is no safe store of value. If there were, the government would have to make its holding illegal, as was done in the case of gold. If everyone decided, for example, to convert all his bank deposits to silver or copper or any other good, and thereafter declined to accept checks as payment for goods, bank deposits would lose their purchasing power and government-created bank credit would be worthless as a claim on goods. (AP) ? Hyundai Motor Co. is recalling some Santa Fe SUVs and Sonata sedans because of problems with their air bags.

The Santa Fe recall involves nearly 200,000 vehicles in the 2007 to 2009 model years. Hyundai dealers will reprogram the front passenger air bag sensors so they will accurately detect when a small adult is seated.

Hyundai said it has received complaints from some adults under 130 pounds whose air bags didn't deploy. The air bags were originally programmed not to go off to protect children.

The company is also recalling 22,500 Sonata sedans from the 2012 and 2013 model years because their side air bags could go off without warning.

Hyundai says it has received 16 complaints about the Sonata's air bags, but no injuries have been reported.

Owners may contact Hyundai at 1-800-633-5151.

As always, our rankings our completely arbitrary. We should note that we pay special attention to national identity in this list. It?s all dependent on who?s wearing what. If the Americans rocked the Swedes outfit, it?d be a disaster ? not as big as the Ralph Lauren scarf/beret debacle, but pretty bad. Because they?re Swedes, however, thick, horizontal stripes and shorts works. They?re Scandinavian. They can pull off anything!

GOP Reps. Trent Franks, of Arizona, and Steve King, of Iowa offered withering criticism during a congressional hearing on Thursday. Franks says the Justice Department's decision to contest several voter ID laws under the Voting Rights Act is particularly galling because the Obama Administration hasn't done enough to protect the right to vote of members of the military serving abroad.

Assistant Attorney General Thomas Perez is defending the Justice Department. He says the department is justified in enforcing the Voting Rights Act and says the department's doing more than ever before to ensure that every American service member can vote.

Beckham says he has role in opening ceremony

(AP) ? David Beckham will have a role in the opening ceremony at the Olympics.

The English soccer star had hoped to play for Britain's team at the games, but he was not included in the squad by coach Stuart Pearce. There will, however, be a spot for him Friday at Olympic Stadium.

"It is some kind of role in the opening ceremony, which I am honored to be involved in because obviously I was involved in the start process with this seven years ago," Beckham told The Associated Press. "And for Seb (Sebastian Coe) to have kept me involved, I'm very proud of that."

But in keeping with the national "save the surprise" campaign, Beckham wouldn't divulge any further details about his role.

One obvious role would be to serve as one of the final torchbearers to help complete the 8,000-mile relay around Britain in the stadium, although it is expected a former Olympian will be given the honor of lighting the cauldron.

There is speculation Muhammad Ali could also play a role in the opening ceremony after the boxing great came to London to appear Tuesday alongside Beckham at an event in London.

"He stood for so many amazing things throughout his life, whether it's what he did in the ring or outside of the ring," Beckham said at the Beyond Sport conference. "His life and his career was all about survival and he is an amazing man."

During the games, Beckham plans to watch some sports while fulfilling his Major League Soccer duties in the United States.

"I'll be going back and forward but I'll definitely be trying to get to a few events," he said.

Beckham has sensed Olympic fever gripping London with just three days until the opening ceremony.

"I was at the stadium yesterday and the park yesterday and you can feel the kind of atmosphere building, the excitement building," Beckham said. "I was brought up around this side of London and, you know, to actually see the changes that have happened and the excitement that's going on is a proud moment."

But Beckham is saddened that he won't get to play in Britain's first Olympic soccer team since the 1960 Games despite making 115 appearances for England, a record for a player other than a goalkeeper.

The former England captain still hasn't given up hope of representing his country again.

"I'll always have ambitions in football as long as I am playing," Beckham said. "I might be 37 years old but I still want to continue to win championships. I still want to continue to be the best that I can be and continue to represent my country in any way, shape or form."

Michael begins with a comparison to environmentalism: Stewardship of valuable resources, and long-term planning. There are cognitive challenges, and issues in providing institutional incentives. (He recommends sucking in as much data as possible, and worrying about adding the metadata later, perhaps through crowdsourcing.)

Michael notes that copyright used to be an opt-in and opt-out system; you had to register, and deposit a copy. Then you had to publish with a ?; anything published before 1989 that doesn?t have the ? is in the public domain. You had to renew after 28 years, and the majority of copyrights (60%) were not renewed. We therefore had a growing public domain.

The court in Golan upheld Congress? right to restore copyright for works published outside the US. This puts the public domain at risk, he says. There is a dangerous argument being made there that if archiving occurs within the library space, fair use goes away. The legal environment is thus unstable.

I think of myself as a shy person, but I never shy away from an opportunity, a challenge, or a once in a lifetime experience. I?m always willing to try something new and to push the boundaries of my comfort zone. At university I?ve been lucky to have an opportunity to challenge myself through my studies and my recreation.

I have challenged myself by trying adventurous sports such as Capoeira, climbing and, my favourite, scuba diving. I?ve learned about photography and developed a great passion for it. It amazes me how, with imagination and practice, we can use the camera to transform something ordinary into something extraordinary. I?ve also learned about other countries and cultures, and it is my dream to visit these places around the world and meet the people who live there.

I have loved the ocean since I was much younger and always would watch the documentary films on TV, but I never thought it was possible for me to be a marine scientist. But I followed my dream, and it has turned out really great. Marine science has introduced me to diving, which I think is the greatest thing in the world. It has also brought me to many different and beautiful places in Indonesia and, one day I hope, around the world. The most important, marine science has made me realize how important the ocean is for humanity.

Indonesia is an archipelago, and many people rely on our oceans for living. The ocean provides us with livelihoods, food and resources. It is also important ecologically. Indonesia has more than 12 percent of the world?s coral reefs, which are important habitat for fish such as manta rays, help protect our coastlines, and can help to reduce carbon dioxide from the atmosphere. Indonesia?s oceans have the richest biodiversity in the world, and it is really important for me and my friends, as the future generation, to protect it so that our grandchildren can enjoy it as we do now.

This is the challenge I have set for myself, to work hard to protect our oceans. I am so happy to be selected for a Guy?s Trust MantaWatch Award, there are not many opportunities like this. An opportunity to learn more about a magnificent creature as manta ray, and to combine my passions for diving, photography and travel. What's driving China's real estate rally? | | MacroBusiness

The buzz is that China real estate is back.? After nearly a year of steep discounting, with both land and housing sales in April?looking like they were falling of a cliff, the market was electrified in late May by stories of would-be home-buyers lining up around the block and entire luxury developments selling out on the days sales opened.? China Securities Journal reported that Beijing housing sales were up 46.5% YoY in May,?Xinhua reported?they were up 50.6% YoY in June, and property agency Centaline says they?ve continue to surge at 37% YoY in the first half of July. Over Dragon Boat Festival weekend, in late June, China?s Housing Ministry said sales volume for Beijing residential property soared 289% YoY (nearly 4x), and Centaline said six other cities saw sales growth greater than 100% YoY that same weekend. In Shanghai, housing sales?surge 65% WoW?in late June and, according to China Business News, primary market sales that month rebounded close to their five-year average.? Securities Times reported that, even in 2nd-tier Wuhan, primary market sales were up 18.7% YoY in June.

Word is that property developers, encouraged by the turn-around in sales, have begun ditching discounts and raising their prices again.? Official statistics for June?showed property prices rising?in more cities (25) than falling (21) for the first time since last September, with?Dow Jones calculating?average nationwide prices increasing by a modest 0.02% after eight straight months of decline. ?Online property site Soufun said?nationwide home prices rose?0.1% MoM in May, the first gain in 10 months, while the China Real Estate Index System (CREIS)?showed the national average?rising 0.05% MoM in June (with Beijing prices bounding ahead by 2.3% MoM in June).? Just this week, Tiahe Group put a new batch of luxury villas on the eastern outskirts of Beijing onto the market for the eye-popping price of US$47.5 million each, which works out to RMB 200,000/sq. meter or $2,925/sq. ft. (for reference, the average price on Manhattan?s pricey Upper East Side is $1,426/sq. ft.).? Perhaps encouraged by such trends, Longfor Properties, Agile Property Holdings and Evergrande Real Estate Group?all made big land purchases?in recent months, with?Evergrande paying a record-setting?RMB 33,000/sq. meter for plot in Guangzhou.? This month, developer?SinoBo easily topped them?by paying more than RMB 41,000/sq. meters in a Beijing land auction.

However, other numbers tell a very different story.? According to data from China?s National Bureau of Statistics, total floor space sold was down -9.3% YoY in May, and -3.3% YoY in June.?? Total sales in June rebounded to +6.9% YoY, the first gain this year, but hardly makes a dent compared to the 33% YoY increase in units for sale.? Meanwhile, land sales resumed their downward slide to -22.4% YoY in June, and new starts were down -16.3% YoY that month, the worst this year.? As a result, growth in total floor space under construction has steadily declined, from 35.5% YoY at the beginning of the year to 17.2% YoY in June.? I?ve been hearing more and more stories about that construction being put on hold, a storyline that appears to be validated by the fact that completions, which were up 45.2% YoY in January, have fallen to 0.3% YoY in June ? basically flat compared to last year, and heading into decline.? No surprise, then, that growth in real estate investment has fallen from 27.9% YoY for 2011 to 16.6% for 1H12 and 11.8% YoY in June ? numbers that will feed directly into lower GDP growth.

In the meantime, China?s property developers are?facing intense financial pressure just to stay afloat.? As the?Wall Street Journal?reports:

Standard & Poor?s Ratings Services says China?s more than 80,000 developers could face a battle for survival as a wave of short-term property loans fall due this year. The risk is that these businesses could become so desperate they will either default, leaving behind half-finished projects at a time economic growth already is slowing, or start offering steep discounts, triggering a price war.

It?s not just the small-fry who are sweating it, either.??China Daily?reports that, among A-share listed developers?(some of China?s largest) 17 expect losses for 1H12, 22 forecast profit growth, while 13 expect lower profits than in the first half of 2011.? Developers tell the paper that losses are mainly due to the rising burden of carrying huge unsold inventories, and that many continue to feel pressure to offer big discounts to raise cash.? The?Wall Street Journal?notes that much of this pressure comes from a tidal wave of trust loans coming due:

Securities brokerage China International Capital Corp. estimates that about 223 billion yuan ($35 billion) of trust loans are due to mature this year, almost half of which reach maturity between July and September, with a further 282 billion yuan due next year. Combined, that represents almost 75% of all outstanding trust financing to the property sector at the end of 2011.

With developers under this much pressure, it?s hard to imagine the market suddenly turning into a seller?s paradise.

So what?s really going on with China?s property market?? Is the rebound in sales real, and if so, can it last?? Is the market bottoming out, surging back, or seeing one of those false rallies that precedes an ever steeper decline?? Since the decline in China?s property market since the end of last summer has been something of a leading indicator of the nation?s broader economic slowdown, and since the assumption of ever-rising property prices underwrites a large part of China?s lending, it?s important to get to the bottom of this question.? If China?s property market is on truly on the mend, it bodes well for a much-anticipated recovery in the 2nd half of this year.? If it?s still broken, things may get worse before they get better.

I?ve spoken to as many people as possible over the past two months ? buyers and sellers, bankers and developers, economists and officials, bulls and bears ? and I?ve heard?five basic theories?to account for the latest bump in China property sales numbers:

  1. Lower Prices are Bringing Buyers Back
  2. Looser Restrictions are Unleashing Pent-Up Demand
  3. Optimistic Buyers are Misreading the Market
  4. Government Intervention is Boosting the Numbers
  5. Developers are Fudging Numbers to Stay Afloat

I?m going to walk through each of these theories in turn, and try to determine which of them ? if any ? offers the most credible explanation for what?s happening in the market.

1. Lower prices are bringing buyers back.??For a while now, one of the main concerns about China?s property market is that prices have spiraled so high that most potential homebuyers find them unaffordable.? But with prices dropping, and wages rapidly rising, maybe that equation is changing, with more buyers willing to snap up what are starting to look like good deals.? The chart below depicts how an economist would see the process: the supply curve shifts outward as overzealous developers build more than they can sell at prevailing high prices, leading them to cut prices and moving the market equilibrium point down and right?along?the existing demand curve.? The behavior of buyers hasn?t changed, but offering them lower prices translates into greater quantity sold.

Based on anecdotal evidence, this certainly does appear to be the rationale many would-be homebuyers are giving for re-entering the market.? As one 29 year-old buyer?recently told the?Financial Times, ?Everyone has been paying attention to this development, because it is a big one. I saw the prices go down and I thought they were now reasonable. I can?t see them falling by much more.?? In early June, a senior official with Beijing?s real estate industry association told Jinghua Times that the reason for strong May sales was aggressive price-cutting, and that when a few projects tried to raise prices, they saw sales fall off immediately.

The problem with this explanation is that ? according to official statistics at least ? prices haven?t fallen all that much and are starting to rise again.??Dow Jones calculates?that prices in June were a modest 1.3% lower than a year before, while?Reuters estimates?1.5% ? not much to get excited about, if you?re a stretched Chinese homebuyer.? And if higher demand is the?effect?of lower prices, there?s absolutely nothing in that dynamic that would cause prices to go back up ? which is what we?re told is now happening.

There are two possible answers to this objection.? The first would be to not put too much credence in the official price statistics.? When prices were rising, over the last few years, there was a noticeable disconnect between the rapid price increases people were seeing the ground ? prices doubling in 2-3 years ? and the modest rises reported in the official statistics.? Over the past year, there has been a similar disconnect between the 20-30% discounts regularly offered at point-of-sale and the 0.1-0.2% MoM price declines in the official and ?independent? (CREIS, Soufun) indices that still get much of that get much of their data from the same industry and local government sources.? There?s plenty of reason to believe that actual prices rose a lot more ? and have fallen a lot more ? than the official data suggests.

Second, if rising incomes are indeed part of homebuyers? calculations, then we need to understand the ?Price? axis on the supply-demand chart as indicating?real?rather than nominal price.?? If other prices, including wages, are rising due to inflation, then home prices actually don?t need to fall much (or at all) in nominal terms to become more affordable in real terms.? The Shanghai E-House real estate research institute, for instance,?calculates that China?s price-to-income ratio?for houses peaked at 8.1 in 2009, fell to 7.4 in 2011, and will decline further this year ? in part due to rising wages, in part to falling (nominal) home prices.? What E-House?s affordability ratio doesn?t explain very well, however, is why the latest sales boom appears to be centered on cities that still have extremely high price-to-income ratios, like 12.4 in Shanghai, 11.6 in Beijing and 15.6 in Shenzhen.

If the recovery in sales volumes really is being driven by lower prices (either nominal or real) that?s hardly good news for developers.? It means that for the market to clear ? for them to sell down the large inventories that are weighing so heavily on their finances ? prices will have to drop even further, or at least not rise for some time.? That means a continued squeeze on their profits, which some may not be able to sustain.? That?s why most developers prefer an alternative explanation of what is happening, one based on a burst of pent-up buyer demand.

Depression Interventions Help Cancer PatientsAlthough screening for depression among cancer patients seems to be a no-brainer, research results have been equivocal on the benefit of interventions.

Now, a new study finds that interventions, especially cognitive-behavioral therapy and pharmacologic interventions, decrease depressive symptoms in cancer patients.

?In the past, we had looked at interventions as a whole ? most of which were designed to help cancer patients cope generally with stress but not specifically with depression ? and found moderate effects,? said Kristin Kilbourn, PhD.,?of the University of Colorado Cancer Center.

?This study shows not only that interventions specific to depression in cancer patients can improve symptoms, but shows which interventions are likely to offer the most benefit.?

Kilbourn and colleagues have published their findings in the Journal of the National Cancer Institute.

In the study, investigators performed a meta-analysis of 10 studies encompassing 1362 patients.

It included high quality studies that met stringent criteria specifying that studies were randomized control trials in which cancer patients reported a significant number of depressive symptoms prior to starting the intervention.

?Still, many questions exist,? Kilbourn said. ?For example, which interventions are best in early cancers versus metastatic disease? Do we find similar effectiveness if patients were diagnosed with depression before their cancer? And which interventions are most effective with different cultural and ethnic subpopulations??

Kilbourn believes future research should explore the benefits of the interventions in more detail including documentation of the gains patients report and the duration of the improvements.

Finally, ?This study supports the notion that screening for depression in cancer patients is important because if we could identify people early in the process and intervene, we now know definitively that we can affect the trajectory of this depression,? Kilbourn said.
