GENEVA ? St. Charles resident Clifford McIlvaine has corrected the plumbing system in his house at 605 Prairie St. as ordered by the court and St. Charles city officials, a city attorney said Wednesday.
?He revised the plumbing as the court told him he had to do last week,? Phil Luetkehans, an attorney for the city of St. Charles, said after a court hearing. The hearing was in the courtroom of Judge Thomas Mueller at the Kane County Courthouse in downtown Geneva.
McIlvaine was warned in court last week that he had to redo the system to prevent his cistern water system from connecting to the city?s water supply or the city would proceed with an application for demolition or repair of the house. A cistern is a tank for storing rainwater.
McIlvaine has signed a court order that he will not use it for bathing or drinking water, and the city wants to make sure the system does not pollute city water.
The city of St. Charles wants McIlvaine to comply with a court order to finish a home-improvement project that started in 1975. The project was supposed to have been completed by Saturday, according to the order.
The city sued McIlvaine in 2010, pushing him to get the project finished, and a work schedule later was agreed upon in court.
McIlvaine recently had been jailed for two weeks after Mueller found him in contempt of court.
?The project is progressing,? Luetkehans said. ?It?s slower than we would have hoped, but it is progressing.?
The roof will not be completed until spring, Luetkehans said.
?We are going to stay on this until it is completed,? he said. ?We are going to be diligently following this and pushing him to complete this as soon as possible.?
McIlvaine declined comment after the hearing.
